Important developments

Early completion - changes to Land Registry procedures

On 3 August 2009 Land Registry introduced new procedures to deal with any application to remove the entries relating to a registered charge where evidence of discharge is not supplied with, or prior to, the application.

  • Where it is lodged together with other applications, rather than raising a requisition for evidence of discharge we will complete the other applications where possible, leaving the entries relating to the charge subsisting in the register.
  • Where it is the sole application, we will reject it as being substantially defective under rule 16(3), Land Registration Rules 2003 regardless of the method of discharge.
